Man Bought Demo Car at Discount, RTO Seized It Over Rs 60 Lakh Tax Dues; Karnataka HC Gives Relief

A man in Karnataka who purchased a luxury demo car at a heavy discount landed in legal trouble after an RTO officer allegedly seized the vehicle citing unpaid road tax dues of nearly Rs 60 lakh. The मामला later reached the Karnataka High Court, which has now provided major relief to the car owner.

What Is the Case About?

According to reports, the buyer had purchased a demo vehicle from a car dealer at a significantly reduced price. The vehicle had reportedly been registered earlier and was later returned, after which it was sold again as a demo car.

However, months later, transport authorities claimed that massive road tax dues were pending on the vehicle. An RTO officer allegedly reached the owner’s residence and seized the car directly, leading to a major legal dispute.

Fraud and Tax Evasion Allegations

Authorities accused the vehicle owner and others of involvement in alleged tax evasion and irregularities in the registration process. A case was reportedly registered under multiple sections related to fraud and revenue loss to the government.

The prosecution claimed that records associated with the vehicle registration had discrepancies and that the state suffered a significant tax loss.

Karnataka High Court Questions RTO Action

While hearing the matter, the Karnataka High Court reportedly expressed strong objections to the manner in which the vehicle was seized.

The court observed that authorities must follow due legal procedure before taking coercive action against any citizen. It also questioned whether proper notices and assessment procedures were completed before the seizure took place.

The High Court emphasized that:

Due process of law must be followed

Recovery proceedings cannot bypass legal safeguards

Vehicle seizure should not be the first course of action

FIR Quashed, Relief to Vehicle Owner

The High Court eventually quashed the FIR against the vehicle owner and ordered relief in the matter. The court also reportedly directed action regarding the conduct of the concerned officer.

At the same time, the court clarified that authorities are free to proceed legally in the future if valid evidence regarding unpaid taxes emerges.
